Terms & Conditions

Thank you for your interest in Yukan Canoe Buidling Workshop. This is the small print. We are Yukan you are ‘the client’.

Please read these terms & conditions carefully before booking a Canoe Building Course. Once payment (deposit or full amount) has been received. Yukan and The client will have entered a binding contract on the basis of these terms & conditions. If you have any questions about them please do not hesitate to contact us.

1. Agreement

Agreement on the basis these terms & conditions arise upon the fulfilment of all of the following: receipt by Yukan of a properly completed booking form accompanied by the payment specified in that booking form; clearance of the payment or deposit into ORCA’s bank account; acceptance by ORCA in writing.

Yukan reserves the right, in its absolute discretion and without the need to give reasons, to refuse to accept a booking. In such circumstances no agreement arises and Yukan will return any payment accompanying the booking form.

The agreement is between Yukan and the client and is the sole agreement between those parties. No variation of these terms & conditions shall be applicable unless agreed in writing by Yukan before the relevant course.

The person signing the booking form shall be deemed to sign that form for his / herself and as agent for all other persons listed on that form and warrants that he / she is appointed agent for that purpose.

The agreement is governed by English law.

2. Payment

The client will pay £100 to secure their place on the course if booking is over four weeks before the course will be held. The remainder of the course fee will be paid four weeks before the course start date.

3. Prices

The Yukan Canoe Workshop Course is £600 per canoe. Up to two people can work on each canoe.

4. Cancellations

If the booking is cancelled by the client(s) (for any reason) and they have paid the full amount the following cancellation change will arise:

Cancellation more than 4 weeks before course/workshop the deposit forfeited.

If cancellation is less than 4 weeks before the course the payment is not refundable. The course can be transferred to another name however.

Deposits are non-refundable.

Yukan reserves the right to cancel a course/workshop up to 4 weeks of the start date, cancelations up to 4 weeks will result in the full amount being paid the client or the option of a new course/workshop date being offered.

6. The conduct of a course

The Client acknowledges that during an Yukan course they are required to submit to the reasonable instructions and leadership of our instructors.

The client acknowledges that persons attending an ORCA course are entitled to expect a high standard of conduct and regard for personal well being on the part of all clients. For this reason the client accepts that Yukan may, in its absolute discretion and without the need to give reasons, arrange for The Client to be removed from a course.

Circumstances in which this might occur include (without limitation) are disorderly or abusive conduct; intoxication; failure take instruction; inadequacy of clothing or equipment.

In such circumstances The Client will not be entitled to a refund and Yukan will not be liable for any losses so resulting.

7. Liability

Yukan makes every effort to minimise risk to Clients and instructs Clients in the safe negotiation of such risk as may remain. Consequently, the Client acknowledges that there are circumstances in which an accident could befall a client without Yukan being at fault and accepts that to that extent they are taking part in an Yukan course/workshop at their own risk.

Yukan only accepts liability for physical injury to a client that is shown to result from negligence on the part of Yukan.

The Client acknowledges that other loss, damage and expense (including, without limitation, loss of money, loss or damage to clothes and possessions, losses arising on the cancellation of a booking and the expenses of delay and harm caused other than by the negligence of Yukan) howsoever arising is not the responsibility of Yukan and that Yukan’s liability is hereby limited.

Yukan accepts no responsibility for the finished quality or workmanship of the end product. Yukan will facilitate all construction stages and if required will help. However, responsibility of building is down to The Client and not Yukan. All use of tools and how to use safely will be shown, we take no responsibility for any injury from using tools in a way other than as shown by our instructor(s).

8. Complaints

In the unlikely event that a client has cause for complaint about a Yukan course, the complaint should be made to a representative of ORCA during the event, in order that corrective action can, if necessary, be taken. However, should a problem not be resolved, complaint should be made in writing within 5 days.

9. Subsquent instruction by the client

Although all Yukan courses are taught by highly experienced & capable leaders, it is not intended that any instruction provided to any Client while on a course will in any way qualify that Client to instruct any third party in canoe building. Yukan hereby excludes any liability it might have to any third party in respect of any loss or damage suffered or incurred by that third party in its reliance on any skills taught by any Client on the basis of having attended any Yukan course.

10. Photography

By attending a Yukan Canoe Building Workshop you are deemed to consent to your photograph being used on our website www.yukan.co.uk or on our social media feed. Photos taken by Yukan staff of people attending our courses belong to Yukan or the photographer.

If you do not consent to Yukan using your photograph in this way please let us know.

11. Data Protection

We never share any information such as email addresses or names with any third party. The information we hold about you from when you book will be stored as emails on our email account. We only keep your name, email, phone number (if you wish to supply) and possibly your address if you have supplied it at any point. If you wish you need only supply your name and email to us for communication. If you wish for your information to be removed for our records or wish to see any correspondence made between us and you or any internal correspondence please contact us.

12. Use of the canoe

A “canoe and kayak, gondola or pedalo designed to be propelled solely by human power” is exempt form the Recreational Craft Detective (RCD) and it is up to end user to decide on appropriate waterway use. However here is a list of inland waterways classification as listed on the ukgov.co.uk

However we recommend that a canoe falls into Category D, SHELTERED WATERS: Designed for use on sheltered coastal waters, small bays, small lakes, rivers and canals when conditions up to and including wind force 4 and wave heights up to and including 0.3m may be experienced, with occasional waves of 0.5m maximum height, for example from passing vessels.

Clients should always be aware of hazards of taking to the open water on their canoe and professional advice and training should be taken before using their canoe.
